    About These Terms

    Please read these Terms of Use carefully before using www.atomdesigns.art or www.atomdesigns.co.uk (together, "the Site").

    By accessing or using the Site you agree to be bound by these Terms of Use. If you do not agree, please do not use the Site.

    These Terms of Use govern your general use of the Site. If you purchase an Artwork through the Site, your purchase is also governed by Atom Designs' Buyer Terms and Conditions, which are made available with each Sales Invoice.

    These Terms of Use were last updated on 20 May 2026.

    1. About Atom Designs

    • 1.1 The Site is owned and operated by Acrotex Limited, a company registered in England and Wales (company number 3514327) trading as Atom Designs.
    • 1.2 Our registered office is at Archer House, Britland Estate, Northbourne Road, Eastbourne BN22 8PW. Our trading address is 443 New Cross Road, London SE14 6TA.
    • 1.3 You can contact us by email at artwork@atomdesigns.co.uk or by post at our trading address.
    • 1.4 Atom Designs is a design studio that markets and sells original textile designs and surface patterns to clients in the fashion, textile and related industries. Atom Designs acts as the agent of freelance designers ("Artists") for the marketing and sale of their original artworks.

    2. Access and Acceptable Use

    • 2.1 We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for personal or legitimate business purposes, subject to these Terms of Use.
    • 2.2 You may not:
      • (a) use the Site in any way that breaches any applicable law or regulation;
      • (b) use the Site in any way that is fraudulent, deceptive, or harmful to Atom Designs, its Artists, its clients, or any other person;
      • (c) interfere with the operation of the Site, including by introducing viruses, trojans, worms, logic bombs or other materially harmful code;
      • (d) attempt to gain unauthorised access to the Site, the server on which the Site are stored, or any server, computer or database connected to the Site;
      • (e) use the Site to build, train, or improve any competing service or product, or to copy any feature, function or graphic for competitive purposes;
      • (f) remove, obscure or alter any copyright, trade mark or other proprietary notice on the Site.
    • 2.3 We reserve the right to suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you are in breach of these Terms of Use.

    3. Intellectual Property and Content

    • 3.1 All content on the Site — including all artworks, designs, images, photographs, text, graphics, logos, code, layouts, and any other material ("Content") — is owned by Atom Designs, the relevant Artists, or licensed to Atom Designs. All Content is protected by copyright, design right, trade mark and other intellectual property laws.
    • 3.2 Nothing on the Site grants you any right or licence to any Content unless expressly stated. The viewing of an Artwork on the Site does not entitle you to reproduce, copy, distribute, or otherwise use it. Rights to use an Artwork are granted only on completion of a sale through Atom Designs and on the terms of Atom Designs' Buyer Terms and Conditions.
    • 3.3 You may not, and you must ensure that no third party on your behalf may:
      • (a) copy, reproduce, download, store, screenshot, or save any Content from the Site except as expressly permitted in these Terms of Use or in a Sale Contract;
      • (b) modify, adapt, translate, or create derivative works from any Content;
      • (c) distribute, publish, transmit, broadcast, or otherwise make any Content available to any third party;
      • (d) use any Content for commercial purposes without a valid licence or assignment from Atom Designs;
      • (e) remove, obscure, or alter any watermark, copyright notice, trade mark or other proprietary marking on any Content.

    4. Prohibition on Scraping and AI Use of Content

    • 4.1 No automated extraction. You shall not, and shall not permit or facilitate any third party to, scrape, extract, copy, download, harvest or collect any Content from the Site by any automated means, including by any bot, crawler, spider, web-mining tool, or similar automated process. Any such use is strictly prohibited regardless of whether the Content is publicly visible.
    • 4.2 No AI training. You shall not, and shall not permit or facilitate any third party to:
      • (a) use any Content as training data, fine-tuning data, reference material, or input for any artificial intelligence, machine learning or generative model;
      • (b) use any Content to generate, produce, or create any output that reproduces, is derived from, is substantially similar to, or is represented as being "in the style of" any Content;
      • (c) use AI tools to modify, alter, manipulate or reproduce any Content;
      • (d) input or upload any Content to any AI system.

    This prohibition applies regardless of whether the use is commercial or non-commercial, regardless of whether the AI system is trained before, during, or after such use, and regardless of where the AI system is located.

    • 4.3 Breach. Any breach of this clause 4 constitutes a material breach of these Terms of Use and a direct infringement of the intellectual property rights of Atom Designs and the relevant Artists. Atom Designs and the relevant Artists reserve all available legal remedies including injunctive relief, damages, and account of profits.
    • 4.4 AI-readable opt-out. Without limiting the generality of clauses 4.1 and 4.2, AI operators are notified through Atom Designs' robots.txt and other technical signals that automated access by AI crawlers and the use of Content for training purposes is not permitted.

    5. Atom Designs' Own Use of AI

    • 5.1 The Site uses third-party AI services for limited features, including a try-on preview function that allows users to visualise how a design might look on a garment.
    • 5.2 Atom Designs routes all such AI requests through OpenRouter, an enterprise AI routing platform, and uses only endpoints that comply with Zero Data Retention (ZDR) standards. Atom Designs has configured the most restrictive available data privacy controls, including:
      • (a) ZDR enforced both at the account level and on every individual request;
      • (b) no use of AI services that may train on user data, whether on paid or free endpoints;
      • (c) no use of AI services that may publish prompts or outputs to public datasets;
      • (d) no consent to data-sharing arrangements in exchange for service discounts.
    • 5.3 Artwork uploaded to power try-on previews is processed in transient sessions on ZDR-compliant endpoints with the additional "No Caching" filter applied. This means the artwork is not stored on disk, not retained in memory or cache, not used to train any AI model, or disclosed to any third party beyond the strictly necessary processing required to generate the preview. Atom Designs does not use OpenAI, ChatGPT, or any consumer-grade AI service for any function involving Artist artworks.
    • 5.4 Atom Designs may from time to time change the underlying AI providers used by OpenRouter as the technology evolves, but commits to maintaining the ZDR-only routing policy described in this clause.
    • 5.5 Try-on preview ownership and use. All try-on previews and other AI-generated visualisations created on the Site are made available solely for the purpose of helping users visualise designs prior to purchase. Such previews remain the commercial property of Atom Designs in respect of their display, distribution and use, and may not be downloaded, copied, screenshotted, exported, or used for any purpose other than viewing within the Site. The underlying Artwork shown in any preview remains owned by the relevant Artist and is not licensed or assigned to any user by virtue of any preview being generated.
    • 5.6 Designer opt-out. Artists represented by Atom Designs may opt out of having their artworks used in the try-on feature. Where an Artist has opted out, their artworks will not be available for try-on visualisation.

    6. Accounts and Purchases

    • 6.1 Where the Site offer the ability to register an account, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
    • 6.2 You must provide accurate, current and complete information when registering and must keep your information updated. You must notify Atom Designs immediately of any unauthorised use of your account.
    • 6.3 Purchases of Artworks through the Site are governed by Atom Designs' Buyer Terms and Conditions, which are made available with each Sales Invoice. By placing an order you agree to the Buyer Terms and Conditions in addition to these Terms of Use.

    7. Third-Party Links

    • 7.1 The Site may contain links to websites operated by third parties. Such links are provided for convenience only and Atom Designs has no control over the content of those websites.
    • 7.2 Atom Designs does not endorse, warrant, or assume responsibility for the content, products, or services of any third-party website. You access third-party websites entirely at your own risk.

    8. Disclaimer and Limitation of Liability

    • 8.1 While Atom Designs makes reasonable efforts to ensure the accuracy of information on the Site, we do not warrant that the Site or any Content will be error-free, uninterrupted, or secure.
    • 8.2 To the maximum extent permitted by law, Atom Designs excludes all warranties, conditions and representations of any kind, express or implied, in relation to your use of the Site.
    • 8.3 Atom Designs shall not be liable to any user of the Site for any loss or damage arising out of or in connection with the use of, or inability to use, the Site, including any indirect, special or consequential loss.
    • 8.4 Nothing in these Terms of Use shall limit Atom Designs' liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law.
    • 8.5 These limitations do not affect your rights as a buyer of Artworks under the Buyer Terms and Conditions.

    9. Privacy and Data Protection

    • 9.1 Your use of the Site is also governed by Atom Designs' Privacy Policy, which explains how we collect, use, store and protect personal data. The Privacy Policy is available on the Site and forms part of these Terms of Use.

    10. Changes to These Terms

    • 10.1 Atom Designs may update these Terms of Use from time to time by publishing a revised version on the Site. Changes take effect from the date of publication. Continued use of the Site after a change indicates your acceptance of the revised Terms.
    • 10.2 Changes to these Terms of Use shall not affect any sale or licence of Artworks already concluded before the change.

    11. General

    • 11.1 Severability. If any provision of these Terms of Use is held by a court to be invalid or unenforceable, the remaining provisions shall continue in full force.
    • 11.2 No waiver. No failure or delay by Atom Designs to exercise any right under these Terms of Use shall constitute a waiver of that right.
    • 11.3 Third party rights. The Artists represented by Atom Designs may enforce the provisions of these Terms of Use that protect their intellectual property rights, in accordance with the Contracts (Rights of Third Parties) Act 1999. Otherwise, no third party shall have any right to enforce these Terms of Use.
    • 11.4 Governing law and jurisdiction. These Terms of Use and any dispute arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales, and shall be subject to the exclusive jurisdiction of the courts of England and Wales.
